Terms of Service

1. What MarginHawk is
MarginHawk is a mobile-first web app that helps small construction contractors track job costs against the price they quoted. You enter a quoted price, log costs against a job, and the app shows budget used, profit, margin, and related job-costing information. It can also read text from receipt photos to help you enter costs faster.
MarginHawk is an estimating and organizing tool. It is not accounting, bookkeeping, tax, payroll, financial, investment, insurance, lending, or legal software, and it does not provide any of those services. See the Disclaimers.
2. Who may use it (eligibility)
MarginHawk is offered in the United States only and is not intended for use outside the United States. To use it, you must:
- Be at least 18 years old;
- Be a business owner, contractor, tradesperson, or an authorized team member using the app for business purposes; and
- Only enter data that is yours or that you have authority to enter.
MarginHawk is not intended for children, minors, or personal or household use.
3. Beta service
MarginHawk is currently a free, invite-only beta. Features may change, break, or be removed, and the service may be unavailable at times. Your use of the beta is also governed by the Beta Tester Agreement.
4. Your account
You sign in with a magic link sent to your email, or with a password if you set one. You are responsible for keeping access to your email and any password secure, and for everything done under your account. Tell us promptly at contact@marginhawk.net if you suspect unauthorized access.
5. Acceptable use
You agree to follow the Acceptable Use Policy. In short: don’t break the law, don’t try to access other people’s data or our systems without authorization, and don’t enter data you have no right to use.
6. Your data and content
The jobs, costs, receipts, and other information you enter are yours. You grant us a limited license to store and process that content only as needed to operate the service and provide it to you, as described in the Privacy Policy. You are responsible for the accuracy of what you enter and for keeping your own copies of anything important; export to CSV is available any time from Settings.
7. Estimates only — verify everything
Every number MarginHawk shows — costs, taxes, budgets, profit, margin, and anything pulled from a scanned receipt — is an estimate that may be wrong. Receipt scanning uses automated text recognition and can misread amounts, dates, and items. You are solely responsible for verifying all figures before relying on them for quotes, billing, tax filings, contracts, or any business decision. For actual accounting and tax matters, consult a licensed professional.
8. As-is, no warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, timely, secure, error-free, or that any calculation or scanned result will be accurate for your situation.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARGINHAWK AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
Our total cumulative liability for all claims relating to the service will not exceed the greater of (a) the total amount you paid us in the twelve (12) months before the claim, or (b) fifty U.S. dollars (US$50). Because the beta is free, this cap is US$50 today.
10. Indemnification
You agree to defend, indemnify, and hold harmless MarginHawk and its operator from any claims, damages, and costs (including reasonable attorneys’ fees) arising from your misuse of the service, your violation of these Terms or the law, your content, or data you entered that you had no right to use.
11. Suspension, termination, and changes
You may stop using MarginHawk at any time. We may suspend, terminate, refuse, modify, or discontinue the service or any account — including for violations of these Terms or for operational reasons — with or without notice. We may also update these Terms; when we do, the Effective and Last updated dates above will change, and continued use after a change means you accept it. Sections that by their nature should survive (disclaimers, liability limits, indemnity, governing law) survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law rules. Except where prohibited, any dispute will be brought in the state or federal courts located in Pennsylvania, and you consent to that jurisdiction.
Arbitration and class-action waiver. Where permitted by law, you and MarginHawk agree that disputes will be resolved by binding individual arbitration rather than in court, and that neither side will bring claims as a plaintiff or class member in a class or representative action. Enforceability of this section depends on applicable law and your circumstances.
13. General
If any part of these Terms is unenforceable, the rest still applies (severability). Our not enforcing a provision is not a waiver of it. We are not liable for delays or failures caused by events beyond our reasonable control (force majeure). You may not assign these Terms; we may assign them in connection with a transfer of the service. These Terms, together with the documents they link to, are the entire agreement between you and MarginHawk about the service.
