Terms of Service

1. The service

MarginHawk (“the Service”) is a tool that helps solo contractors track quoted prices, costs, and computed profit on jobs they create. By using the Service you agree to these Terms.

2. Estimates only — not professional advice

MarginHawk provides estimates for your own use. It is NOT accounting, tax, financial, or legal advice.

You are solely responsible for verifying every figure you see in MarginHawk before relying on it for business decisions, contracts, client billing, tax filings, or any other purpose. We strongly recommend consulting a licensed accountant or tax professional for actual accounting and tax matters.

3. As-is, no warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, timely, secure, error-free, or that calculations produced by the Service will be accurate for your specific situation.

4. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBLEDGER AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

Our total cumulative liability for any and all claims arising out of or related to the Service shall not exceed the greater of (a) the total amount you paid to MarginHawk in the twelve (12) months preceding the claim, or (b) fifty US dollars (US$50). If you used the Service for free, this cap is US$50.

5. Your responsibilities

  • You are responsible for the accuracy of the information you enter.
  • You are responsible for verifying any output before relying on it for business or tax purposes.
  • You are responsible for keeping your login credentials safe.
  • You will not attempt to access, scrape, or otherwise interfere with other users’ data or the underlying systems.

6. Privacy

Your data is handled per our Privacy Policy. By using the Service you also agree to that policy.

7. Acceptable use

You will not use the Service to violate the law, infringe anyone’s rights, send unsolicited messages, distribute malware, or attempt to gain unauthorized access. We may suspend or terminate accounts that violate this section.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or for operational reasons. On termination, the limitations and disclaimers above survive.

9. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law provisions. Any dispute will be brought in the state or federal courts located in Pennsylvania, and you consent to that jurisdiction.

10. Changes to these Terms

We may update these Terms. The Effective Date at the top will move forward. Continued use after a change constitutes acceptance.
